1. Agreement to Terms

By accessing or using FitForge ("the Platform"), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, you may not access or use our services. These terms apply to all users, including fitness enthusiasts, coaches, and administrators.

2. Subscription Services

2.1 User Subscriptions

FitForge offers various subscription tiers (Free, Pro, and Elite) with different features and pricing. By subscribing to a paid plan, you authorize us to charge your payment method on a recurring basis.

2.2 Coach Subscriptions

Coaches pay a monthly platform fee of $49.99 plus a 5% transaction fee on all client payments. Coach subscriptions are billed monthly and provide access to all coaching tools and features.

2.3 Trial Periods

Some subscriptions may include a trial period. During the trial, you will have full access to subscription features. Your payment method will be charged at the end of the trial period unless you cancel before the trial ends.

4. Cancellation Policy

You may cancel your subscription at any time through your account settings. Upon cancellation:

• Your subscription will remain active until the end of your current billing period
• You will not be charged for subsequent billing periods
• No partial refunds will be issued for the remaining days in your billing cycle
• Access to premium features will end when your subscription expires
• Your data will be retained for 30 days after subscription ends, then may be deleted

5. User Responsibilities

As a user of FitForge, you agree to:

• Provide accurate and complete information when creating your account
• Maintain the security of your account credentials
• Use the platform only for lawful purposes
• Not share, resell, or redistribute your subscription access
• Consult with healthcare professionals before starting any fitness program
• Take responsibility for your own health and fitness decisions

6. Coach Responsibilities

Coaches using the FitForge platform agree to:

• Hold valid certifications and credentials as represented
• Provide accurate information about qualifications and experience
• Maintain professional conduct with all clients
• Not provide medical advice unless properly licensed
• Honor all scheduled sessions or provide adequate notice for cancellations
• Comply with all applicable laws and regulations

7. Limitation of Liability

FitForge provides fitness tracking, coaching connections, and wellness tools for informational purposes only. We are not responsible for any injuries, health issues, or adverse effects that may result from using our platform or following any fitness programs. Users should consult with qualified healthcare providers before beginning any exercise program. To the maximum extent permitted by law, FitForge shall not be liable for any indirect, incidental, special, consequential, or punitive damages.

8. Intellectual Property

All content, features, and functionality of the FitForge platform, including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, and software, are the exclusive property of FitForge and are protected by international copyright, trademark, and other intellectual property laws.

9. Termination

We reserve the right to suspend or terminate your account and access to the platform at any time, without notice, for conduct that we believe violates these Terms, is harmful to other users, or is otherwise objectionable. Upon termination, all licenses and rights granted to you will immediately cease.

10. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting a notice on the platform or sending an email. Your continued use of the platform after changes are posted constitutes acceptance of the modified Terms.
